Consumer enquiries about returns and refunds should be directed through the respective point of purchase. The following clauses govern our terms of trade.
Buyers must examine goods upon delivery and notify the seller within seven (7) days of any evident defects, damage, quantity shortages, or description failures. Any other alleged defects must be reported as soon as reasonably possible after discovery. Failure to notify within this period may affect your ability to make a claim.
Under applicable State, Territory and Commonwealth Law (including the Competition and Consumer Act 2010 — CCA), certain statutory implied guarantees and warranties may be implied into these terms and conditions. Battery Australia acknowledges these rights and does not seek to exclude or limit them beyond what is permitted by law.
Battery Australia acknowledges that nothing in these terms purports to exclude Non-Excluded Guarantees under applicable law. Our terms operate in addition to, and do not override, your rights under the Australian Consumer Law.
Except for Non-Excluded Guarantees under applicable law, Battery Australia makes no other warranties or guarantees regarding the quality or fitness for a particular purpose of goods supplied. To the maximum extent permitted by law, our liability is limited as set out in these terms.
Where replacement of a product is not reasonably possible, Battery Australia may, at its discretion, refund the payment amounts received for the defective goods. The availability of this remedy is subject to the conditions set out in our Refund and Returns Policy.
For transactions that do not qualify as consumer transactions under the Australian Consumer Law, Battery Australia's liability is limited solely to the value of the express warranty provided with the goods, or manufacturer warranties where applicable. No further liability is accepted.
Returns will be accepted only where: (a) the buyer has complied with the inspection requirements above; (b) Battery Australia has confirmed the existence of a defect in the goods; (c) the goods are returned promptly at the buyer's cost; and (d) the goods are returned in substantially the same condition as at the time of delivery.
Battery Australia is not liable for defects or failures caused by: improper maintenance by the buyer or a third party; misuse or use in a manner inconsistent with manufacturer guidelines; continued use of the goods after a defect becomes apparent; failure to follow instructions provided with the goods; or fair wear and tear over time.
Battery Australia may, in its absolute discretion, accept non-defective goods for return. In such cases, Battery Australia may require the buyer to pay a handling and restocking fee of up to thirty-five percent (35%) of the original purchase price. This is to cover processing, inspection, and restocking costs.
Where applicable law requires Battery Australia to accept the return of goods, Battery Australia will accept such returns only under the conditions imposed by that law. Nothing in these terms is intended to conflict with or limit any mandatory rights you have under Australian Consumer Law.
